1. Acceptance of Terms

By creating an account or using the 3D Casas Media Portal ("Portal") at media.3dcasas.com, you ("User") agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use the Portal.

2. Description of Services

The Portal provides real estate media management tools including property websites, a Creative Studio flyer generator, photo galleries, virtual tour integration, document storage, and related features. Services may change at any time without prior notice.

3. User Accounts

You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account. You agree to provide accurate information and to notify 3D Casas LLC immediately of any unauthorized access.

4. Content Ownership & License

Your Content: You retain ownership of photos, text, logos, and other materials you upload ("User Content"). By uploading User Content, you grant 3D Casas LLC a non-exclusive, royalty-free license to host, display, and distribute that content solely for the purpose of providing Portal services to you and your clients.

Platform Content: Templates, layouts, designs, and tools provided by the Portal remain the property of 3D Casas LLC and may not be copied, redistributed, or used outside the Portal without written permission.

5. Property Data & Accuracy

You are solely responsible for the accuracy of all property information, descriptions, pricing, and media uploaded to the Portal. 3D Casas LLC does not verify property data and makes no representations about its accuracy. Public property websites generated by the Portal display information exactly as provided by the User.

6. Photo Licensing & Media Usage

All media produced by 3D Casas LLC (photos, virtual tours, floor plans, etc.) is copyrighted by 3D Casas LLC upon creation. You receive a non-exclusive, royalty-free license to use the media solely for marketing and promoting the specific property featured. This license is perpetual for that property but non-transferable to third parties without prior authorization.

Modifications to media (applying virtual staging, editing, or alterations of any kind) without authorization constitute copyright infringement and are strictly prohibited. For any use beyond original property-specific marketing, prior written authorization from 3D Casas LLC is required.

You represent and warrant that you have the right to use all photos, images, virtual tours, and media you upload to the Portal. You agree not to upload content that infringes on third-party copyrights, trademarks, or intellectual property rights.

7. Custom Edits & Virtual Staging

3D Casas LLC delivers media as accurately captured during the site visit, enhanced with industry-standard editing for lighting, color correction, and clarity. Upon your request, we may perform custom edits (e.g., virtual staging, color adjustments, or other enhancements).

You are solely responsible for requesting, reviewing, and approving any custom edits, and for ensuring all media use — edited or otherwise — complies with applicable laws, ethical standards, and real estate disclosure requirements. This includes avoiding any misrepresentation of the property (e.g., no alterations to imply conditions that do not exist). Examples of prohibited requests include but are not limited to: removing structural defects, concealing material property conditions, adding non-existent features, or altering the surrounding environment in a materially misleading way.

THE USER ASSUMES ALL LIABILITY FOR THE USE OF EDITED OR VIRTUALLY STAGED IMAGES. 3D CASAS LLC SHALL NOT BE HELD LIABLE FOR ANY CLAIMS, DAMAGES, OR LEGAL ACTIONS ARISING FROM THE USE OF EDITED MEDIA, INCLUDING CLAIMS OF MISREPRESENTATION, FRAUD, OR VIOLATION OF REAL ESTATE DISCLOSURE LAWS. 3D Casas LLC disclaims responsibility for claims arising from User-requested edits or subsequent misuse; see Indemnification for details.

8. Floor Plans Disclaimer

Floor plans provided by 3D Casas LLC are for marketing purposes only, illustrating the general layout of the property. ALL MEASUREMENTS ARE APPROXIMATE. Floor plans may not be used to determine the valuation of the property or to estimate repairs or improvements.

3D Casas LLC is not a licensed appraiser, surveyor, or engineer. Square footage calculations are a courtesy provided at the agent's request based on on-site observations and client-provided information — they may vary from official appraisals or county records.

ALL PARTIES USING FLOOR PLAN DOCUMENTS AGREE TO TAKE THEIR OWN MEASUREMENTS TO DETERMINE THE LAYOUT AND SIZE OF THE PROPERTY. 3D Casas LLC disclaims any liability for inaccuracies, errors, or omissions in floor plans. The User is responsible for verifying measurements for any legal, financial, or contractual use.

9. Flyers & Generated Materials

Flyers and marketing materials created through the Creative Studio are for your professional real estate use. You are responsible for ensuring all generated materials comply with local real estate advertising regulations and MLS rules.

10. Limitation of Liability

3D CASAS LLC SHALL TAKE REASONABLE CARE IN PERFORMING ITS SERVICES. HOWEVER, TO THE MAXIMUM EXTENT PERMITTED BY LAW, 3D CASAS LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, BUSINESS, GOODWILL, OR DIMINUTION IN PROPERTY VALUE, ARISING OUT OF OR RELATED TO YOUR USE OF THE PORTAL OR SERVICES.

3D Casas LLC's total liability for any claim, whether in contract, tort, or otherwise, shall not exceed the total fee paid by the User for the specific job giving rise to the claim. Nothing in this Agreement limits liability for gross negligence, willful misconduct, or other liabilities that cannot be excluded under applicable law.

11. Disclaimer of Warranties

THE PORTAL IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. 3D Casas LLC does not warrant that the Portal will be uninterrupted, error-free, or secure.

12. Indemnification

You agree to indemnify, defend, and hold harmless 3D Casas LLC, its officers, directors, employees, and agents from and against any and all claims, demands, actions, costs, damages, losses, liabilities, and expenses (including reasonable attorneys' fees) arising out of or related to: (i) your use, distribution, or modification of delivered media; (ii) any breach of these Terms; (iii) any third-party claims resulting from your use of the Portal or media; or (iv) your User Content. This indemnification obligation survives termination of these Terms.

13. Account Termination

3D Casas LLC may suspend or terminate your account at any time, with or without cause and without prior notice. Upon termination, your right to access the Portal ceases immediately. We are not obligated to retain your data after account termination.

14. Data & Privacy

We collect and store the information you provide (email, profile details, property data, uploaded media) to deliver Portal services. We do not sell your personal information to third parties. 15. Modifications to Terms

3D Casas LLC may update these Terms at any time. Continued use of the Portal after changes constitutes acceptance. We will notify users of material changes via the Portal or email.

16. Governing Law

These Terms are governed by the laws of the State of New Mexico. Any disputes shall be resolved in the courts located in New Mexico.
